Terms and Conditions
Last updated on 6 October 2026.
1. Definitions
In these terms we mean by: • AmsterSite, “we” or “us”: AmsterSite, Weteringschans 165c, 1017 XD Amsterdam; • client: the person or organisation that gives us an assignment or receives a quotation from us; • agreement: any arrangement between AmsterSite and the client about our services; • services: everything we do for the client, such as creating websites, logo design and social media management.
2. Applicability
These terms apply to all quotations, agreements and services of AmsterSite. Deviations only apply if we have agreed on them in writing (including by email).
The client's own general terms do not apply unless we have expressly accepted them in writing. If a provision of these terms turns out to be invalid, the other provisions remain in force.
3. Quotations and prices
Our quotations are without obligation unless the quotation states otherwise. A quotation is valid for the period stated in it.
Prices on our website, such as “from” prices, are an indication. What we charge for an assignment is stated in the quotation or the order confirmation, including whether the amount includes or excludes VAT.
4. Agreement and execution
An agreement is formed as soon as the client accepts our quotation in writing or by email, or as soon as we start the work at the client's request.
We carry out assignments carefully and to the best of our ability. Where necessary or useful, we may involve freelancers or other specialists for (parts of) an assignment. Stated deadlines and delivery dates are estimates, not strict deadlines, unless we have expressly agreed otherwise.
5. Client obligations
The client makes sure we receive all information, texts, images and login details we need for the assignment in time. Delays caused by late or missing materials are the client's responsibility.
The client guarantees that materials they provide do not infringe the rights of others, such as copyrights or trademarks. Materials provided by the client remain the client's property. The client is responsible for the content and use of their own website and social media channels.
6. Changes and additional work
If the client wants to change or add something after the agreement has been made, we discuss it first. Work outside the agreed assignment may be charged separately after consultation.
7. Payment
The client pays our invoices within the payment term stated on the invoice.
If the client does not pay on time, we first send a reminder. If payment still does not follow, we may charge the statutory interest and reasonable collection costs and suspend the work until payment has been made.
8. Intellectual property
The intellectual property rights to what we create for an assignment, such as designs, logos, websites and texts, remain with AmsterSite until the client has paid everything owed for that assignment. After that, the client may use the result for the purpose we agreed on. Any transfer of rights is recorded in writing.
Unless agreed otherwise, we may show the work and the client's name in our portfolio and our own promotion.
9. Confidentiality
We treat the client's confidential information as confidential and use it only for the assignment. Freelancers and other parties we involve observe the same confidentiality. The client treats our confidential information in the same way.
10. Third-party services and products
For some assignments we use services or products of third parties, such as hosting, domain names, software, fonts, stock images and plug-ins. Their own terms and licences also apply. We are not responsible for outages, changes or price changes at those third parties.
11. Liability
Our liability is limited to direct damage and to at most the amount we have charged for the assignment concerned, excluding VAT.
We are not liable for indirect damage, such as consequential loss, lost profit or loss of data. These limitations do not apply in case of intent or deliberate recklessness on our part.
12. Force majeure
We are not liable if we cannot meet our obligations, or cannot meet them on time, due to circumstances beyond our control, such as outages at internet or hosting providers or power failures. While the force majeure lasts, our obligations are suspended. If it lasts longer than is reasonable, either party may end the agreement; work already done is then invoiced proportionally.
13. Cancellation and termination
An ongoing service, such as social media management, can be cancelled with the notice period stated in the agreement. If the client ends an assignment early, we invoice the work done up to that moment.
We may suspend or terminate the agreement if the client does not meet their obligations, goes bankrupt or applies for a suspension of payments.
14. Use of this website
The information on this website has been compiled with care but may be incomplete or out of date. No rights can be derived from its content.
Texts, designs and other material on this website may not be copied or reused without our permission. We are not responsible for the content of other websites we link to.
15. Changes to these terms
We may change these terms. Ongoing assignments remain subject to the version that applied when the agreement was made, unless we agree otherwise.
16. Applicable law and disputes
All agreements with AmsterSite are governed by Dutch law. If we cannot resolve a dispute together, it will be submitted to the competent court in the district where AmsterSite is established, unless mandatory law provides otherwise.
If the client is a consumer, the rights that the law grants to consumers also apply. These terms do not affect those rights.
